Since that time, we have provided real estate representation, elder law, estate planning and corporate law services to our clients in Central Florida. Although we provide representation in civil courts, our emphasis has been toward resolving issues in the most economically sensible way, which usually does not involve courts. The recent addition of Craig Spanjers adds trial expertise to the services we provide, but does not change our emphasis on resolving problems quickly and efficiently.</span></strong></p>

<p><strong>One of the first decisions on the validity of actions based upon quickly-signed affidavits was released.&nbsp; Freemon v. Deutsch Bank, decided in October, 2010 by the 4th District Court of Appeal.&nbsp; It concerned an attack after the judgment was entered and the appeal time had run.&nbsp; The process and attention of the officer that signed&nbsp; the affidavit was better than many I have seen, and the court ruled that no miscarriage of justice was alleged.</strong></p>
<p><strong>A major aspect of the case was that the attack was made late.&nbsp; After the judgment is entered, the bar gets much higher.<br /> </strong><br /> <strong>&nbsp;I think affidavits can be challenged before hearing.&nbsp; I have a fee affidavit from a mill on my desk, and I am confident that I could get a continuance to depose the affiant.&nbsp; I would be surprised if the affidavit was accurate.&nbsp; My understanding is that the average foreclosure mill file gets about 15 minutes of attorney time by the time the summary judgment is filed.&nbsp; The rest is done by non-attorneys.&nbsp; Although I think the attached decision is correct, a circuit judge would be reluctant to ignore an allegation of perjury upon application timely made.</strong></p>
